He is a recorder in the Manchester courts (a recorder being the first rung of the ladder on the way to becoming a proper circuit judge).
Why a cnut?
He recently presided over a case where a woman driver, speeding at more than 60mph in an 30mph zone whilst three times over the drug limit, hit a pedestrian who was left in hospital for 12 weeks (3 of which were in a coma) with a brain injury and various fractures to the skull and ankle.
According to Lazarus, he saw no evidence that the drugs had any direct impact on the woman’s driving. Really? Over 3 times the drug limit and it didn’t affect her at all? Who is he kidding? If it had been a male driver a shandy over the drink / drive limit and doing 35mph in a 30 mph zone I wonder if he would have said the same? Of course he wouldn’t.
Not only that, the dipstick has fallen for the old “mental ‘elf” issues, is now over her drug addiction and is very, very sorry sob story and refused to jail her as, unbelievably, he said prison at this moment in time is ‘very harsh’ due to covid lockdowns. Well tough sh!t. I didn’t think prison was supposed be easy. I always thought it was meant to be tough to act as both punishment and deterrent. Clearly I’m wrong.
I expect that with such a soft as sh!t attitude to criminal justice Lazarus will be fast tracked to the High Court so he can issue ASBOs to all the hard done by terrorists, murderers and organised crime gangs. That’ll teach ’em, Robert, won’t it?

Perhaps the cunt would like to accompany us to a RTC similar to the above, involving a child. He could help us and the police zip the child into a body bag, come to the childrens hospital with the body and sit in the back with the patents – always a barrel of laughs, that part – and, if he’s lucky, the police can take him back to the scene so he can help the fire brigade hose the blood off the road. I am afraid that the judicial system is now about minimising costs especially of imprisonments. Any magistrate, judge etc who is seen as harsh ( ie enforcing the law) is regarded as a dinosaur in need of elimination.

The “legal limit” mentioned in the link is not a legal limit in relation to ability to drive/operate machinery &c. It is part of the badly implemented incorporation of “drug-driving” into the preëxisting drink-driving legal schema in UK. The complexity of distinguishing between DG10 and DR80 offences can be, as seen here, a kind of “loophole” in the legislation.
Broadly speaking, for a “drug-drive” offence of this type to be actionable in law, it is legally necessary to be able to demonstrate that the effect(s) of the drug(s)¹ are/were at least part of the cause of the accident. This is clearly how it should be.
Specifically, this is what Lazarus, J was considering when passing sentence here. The presence of the liver metabolite of cocaïne (ab)use, benzoylecgonine, is a red herring unless the drug was still actively impairing the driving to such an extent that it played a rôle in the unfortunate collision (perDR80 Statute law), which in this case Lazarus determined it didn’t.
More clearly put, the benzoylecgonine (and other) tests only determines if cocaïne has been ingested recently and not whether the blood-plasma level of the intoxicant was sufficient to impair judgment and ability to operate machinery.
Were it otherwise, it would be a matter of some facilty to introduce legislation which made driving illegal if any intoxicant had been ingested (in the case of cannabis this proscription would last many months) irrespective if the effects of the narcotic had long since expired.
The sentencing was decided on the basis of excess speed alone: a correct judgment.

I agree. Our resident legal expert has explained the reason for the sentencing very well. Clearly and concisely. Lazarus, J was following the sentencing guidelines according to current law.
However. The law is indeed an ass. And this is a very clear example of that.

Surely if she has a medical (mental health) condition, as per her legal defence, which causes her to drive at inappropriate speeds, then clearly the DVLA should revoke her licence.

PM@ – I have worked in law and am utterly baffled by this – if a driver has “mental health issues” and cannot help speeding or driving under the influence of anything they are a ticking time bomb and should not be driving.
I am astonished by this ruling – but know my excuse for when they catch me on the rather tasty 350LC I have my eye on! 😀👍
